For Short Assured Tenancy\u2019s (which I have &amp; an AT5) the procedure is a Section 33. This is outlined on Shelter\u2019s website and, indeed, across all sites that deal with homeless. However North Ayrshire Council refuses to accept my Section 33.<\/p>\n<p>&nbsp;<\/p>\n<p>Policy is clear as setup in Housing (Scotland) Act 1987 as amended<\/p>\n<p>&nbsp;<\/p>\n<p>\u201cThe duties include a <a href=\"http:\/\/www.gov.scot\/Topics\/Built-Environment\/Housing\/homeless\/las\/legislation\">statutory responsibility<\/a> to anyone threatened with or experiencing homelessness. By law, local authorities must offer a minimum of temporary accommodation, advice and assistance to all homeless households and those at risk of homelessness.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>Due to illness I am categorised as being c) a person who is vulnerable as a result of (v) (vi)<\/p>\n<p>&nbsp;<\/p>\n<p>1<\/p>\n<p>Amendment of section 25 of the 1987 Act<\/p>\n<p>(2)<\/p>\n<p>In subsection (1)\u2014<\/p>\n<p>(a) for paragraph (c) substitute\u2014<\/p>\n<p>\u201c(c) a person who is vulnerable as a result of\u2014<\/p>\n<p>(i)<\/p>\n<p>old age;<\/p>\n<p>(ii) mental illness;<\/p>\n<p>(iii) personality disorder;<\/p>\n<p>(iv) learning disability;<\/p>\n<p>(v) physical disability;<\/p>\n<p>(vi) chronic ill health;<\/p>\n<p>(vii) having suffered a miscarriage or undergone an abortion;<\/p>\n<p>(viii) having been discharged from a hospital, a prison or any part of the<\/p>\n<p>regular armed forces of the Crown; or<\/p>\n<p>(ix) other special reason;\u201d,<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I don\u2019t understand why the Council won\u2019t help me.
